So it begins... A woman upset that she bought the video game "Grand Theft Auto: San Andreas" for her 14-year-old grandson without knowing it contained hidden, sexually explicit scenes sued the manufacturer Wednesday on behalf of consumers nationwide.

Florence Cohen, 85, of New York, said in the lawsuit filed in U.S. District Court in Manhattan that the game's manufacturer, Rockstar Games, and its parent company, New York-based Take Two Interactive Software Inc., engaged in false, misleading and deceptive practices.

She sought unspecified damages on behalf of herself and all consumers nationwide, saying the company should give up its profits from the game for what amounted to false advertising, consumer deception and unfair business practices.

Cohen said in the suit that she bought the game in late 2004 for her grandson when it was rated "M" for mature, for players 17 and older. According to the suit, she directed that it be taken away from her grandson, which was done.

Here is the kicker that really bites me... She bought the M (meaning age 17+) rated game for her 14 year old grandson. She shouldn't have bought the game in the first place for a 14 year old. Here comes the attack of the Americans that want to ride/work the system for a free dime through the legal system. If parents want to ignore the rating system then their case should be thrown out of court and the video game community needs to have some slack given to them. The blame here is going to parents these days.

the laywers will point that out right off the bat I would hope, prolly use some lame responce like she didnt understand the rating because she is so old.

M is 17+ adult is 18+, the only difference is that adult is not sold in stores like circuit city when it is adult?

Ugh I hate people like that. They should have a required euthanasia drug administered for anyone who joins this lawsuit bandwagon.

Do you know if this complaint is over the pc version? Because you can't really- (well you can but it'd be difficult) to mod San Andreas on console. Therefore her 14 year old son wouldn't even be able to access any of the "sexually explicit" material that she's complaining about.

I'd say this lawsuit is kinda like suing a softcore porn site for having hardcore pictures in its database which can only be accessed after installing a program to open it.

It was bought in late 2004 and that is before the PC version came out, so i am guessing that this case revolves around the console version.

I think this should be a very easy, straight forward case. I mean she is sueing for something that she wasnt suppose to buy for a 14 year old in the first place. cases like this should eighter be thrown out automatically by the court or refused and punished by a fine as frivulous and vaxatious holding up an overworked court that has better things to do than trying a totally idiotic case. an extra fine should be issued for the women for giving a grandchild a game that is forbidden by law. I think this is logical. a legal system that allows lawsuits like this to be even filed is- in my opinion sick and retarded and should be changed.

Either way, you don't buy 17+ games for 14 year olds. She should learn to read...I bought HL2 for myself when I turned 17...

Yeah, it does show the stupidity of some of the public. When it's stated clearly on the box that the game is intended for 17+, then that's what it's intended for, not for a young grandson. Oh well, I think that's why the price of video games keep going up, but also because of unprecedented customer demand.

What I dont get it is that you need a mod to unlock the sex scenes. Why would that effect the rating its not built into the game. You need an outside program to unlock it.

Also why were the Xbox and PS2 versions pulled off? I doubt anyone will ever be able to unlock it for the xbox version.

:pulls foot out of dumb lady's ass: ahh, anyways.....Yeah I believe that's what the world is coming to, and is already there in a sense: that is, frivolous litigation spanning across many issues, everything from video games having so-called "porn" and "graphic violence", to someone smoking around a non-smoker in a smoking area. I tell ya, if I hear any more about frivolous lawsuits like this, I will permanently rip my hair out with Nads, roflmao :axe:

right, but that's really not my issue with this whole thing. my issue with it is that she bought the game for her 14 year-old grandson, knowing fully that the game carried a Mature (17+) rating (and you can't tell me she didn't because any assertive parent or grandparent (as in this case) would take the time to check the rating to make sure it was suitable for that child). Everyone has to suffer the loss of a fairly awesome game with a great soundtrack because of the action of one. I really liked that game when I played it, and now it's pulled off shelves. I just don't understand....

i think every parent who buys gta then gets pissed cuz THEY (themselves) failed to read the warnings should be systematically shot in the forehead..so we can get on with playin the damn game

she more than likely won't, due to the fact that the main contents of the game material is rated M, which is for age 17+, and her grandson is 14; the big picture here is that the porno scene in the coffee shop, from what I understand, is a patch not intended for the game. the suit should be dismissed, otherwise we have a bunch of frickin liberals on the bench who think people should be rewarded for their own ignorance.
