See i purchased and downloaded the game online from Sierra (Big mistake). I asume that this version is post v002. Because after installing the game i did not patch the game and it still does it... always. I just build this PC a few days ago and made sure i got the newest Drivers, BIOS , DirectX etc....

I finnaly found this. Well it is February the 25th, 2008. And there is still no fix for this. I am in contact with Sierra entertainment about this. btw. I own the (ASUS) ATI 3870x2. I will post if Sierra comes up with something....
