AMD Surviving Black Friday OFFICIAL SWEEPSTAKES RULES

Black Friday is right around the corner, and AMD is here to help make the shopping experience easy, fun and rewarding!

AMD’s Facebook page is currently hosting a deal stream for notebooks, desktops, processors and other goodies featuring AMD technology, all of which were uncovered and tweeted with the #AMDdeals hashtag by AMD fans and shoppers all over North America.

Beginning Wednesday, November 24th at 6 a.m. CT, every deal submitted with the hashtag counts as one entry into a contest to win fabulous prizes. Take a look at the official contest rules below.

Surviving Black Friday OFFICIAL SWEEPSTAKES RULES
No purchase required to enter or win. A purchase will not increase your chances of winning. Maximum one (1) prize per person, e-mail address, or Twitter handle.

1. Eligibility: Surviving Black Friday (the “Sweepstakes”) is open only to legal residents of fifty (50) United States (including the District of Columbia) and Canada (excluding Quebec) who are at least thirteen (13) years of age as of the start of the Entry Period (defined below) or older (if under the age of majority, parental permission required). Employees of Advanced Micro Devices, Inc., GLOBALFOUNDRIES Inc., and Intel Corporation, and each of their subsidiaries, affiliates, officers, directors, employees and agents, and the immediate family (defined as parents, children, siblings and husband or wife) of each such employee, together with those with whom such employees are domiciled, are not eligible to participate.

2. Sponsor: The Sweepstakes is sponsored by Advanced Micro Devices, Inc., One AMD Place, PO Box 3453, Sunnyvale, CA 94088-3453 (“AMD” or “Sponsor”).

3. Agreement to Official Rules: Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. Entry Period: The Sweepstakes begins on November 24, 2010, at 6:00 a.m. CT and ends on November 26, 2010, at 12:00 midnight CT (the “Entry Period”). Entries that are submitted before or after the Entry Period will be disqualified. Sponsor’s computer will be the official timekeeping device for the Sweepstakes.

5. Submission: Entrants are invited to use the Sweepstakes Hashtag (#AMDdeals) to post or retweet (RT) any deal in order to qualify for the Sweepstakes, which must include a link to an AMD product deal offered through a retailer. Either a post or a retweet will quality for entry as long as the Sweepstakes Hashtag is included in the response along with a link to an AMD product deal. Entrants may post and retweet as many deals as they choose, however only the first five (5) posts and/or retweets per person or Twitter handle per Entry Sub-Period will be entered into the prize draw.

Entrants may include other information in the Tweet so long as the Tweet does not:

* Contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
* Disparage Sponsor or any person or party affiliated with the promotion and administration of this Sweepstakes;
* Feature brand names or trademarks other than those of Sponsor;
* Contain text or imagery that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;
* Contain text or imagery that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; or
* Reference any competitor of Sponsor, or any products, services or deals of any third party.


Limit: No more than five (5) entries per person or Twitter handle per Entry Sub-Period will be counted. Duplicate retweets or posts from the same person or Twitter handle will not be counted as entries.

Any personal data an entrant submits as an entry will be stored on servers in Canada and the United States of America. Where applicable, entry into the Sweepstakes constitutes entrant’s consent to the export of any personal data collected by Sponsor to the United States of America and its use there only for the purposes of administering this Sweepstakes and associated processing (e.g., but not limited to back-up, archiving). Entrants’ personal data will be stored on these servers and used for the purposes of administering this Sweepstakes and associated processing of entries. For further information about how Sponsor manages your personal data, please see Sponsor’s privacy policy at http://www.amd.com/us/aboutamd/Pages/privacy.aspx. Your conduct and privacy on the Twitter service are governed by the terms available Twitter.com.

6. Winner Selection: All qualified entries received during each prize Entry Sub-Period will be pooled together, and drawing of winners will occur as follows:

For each Entry Sub-Period, one (1) potential prize winner will be chosen at random from among all eligible entries received during the Entry Sub-Period. There will be a total of eighteen (18) Drawings, one for each Entry Sub-Period, which will take place within 24 hours of the end of each Entry Sub-Period.

The potential Drawing prize winners will be notified by Twitter Direct Message (DM) after each Drawing. The potential Drawing winners must reply to the notification with any requested information within five (5) days of the time the win notification was sent. Potential prize winners may be required to sign and return to Sponsor, within ten (10) days of the date notice is sent, a confirmation of an Affidavit of Eligibility, Liability and Publicity Release (if a legal resident of the United States) (“Affidavit”) or a Declaration of Compliance (if a legal resident of Canada) (“Declaration”) (except where prohibited) in order to claim his/her prize. If a potential winner of any prize cannot be contacted, fails to respond to the notification within five (5) days (if applicable), or fails to sign and return the Affidavit or Declaration within the required time period (if applicable), he/she forfeits the applicable prize.

Additionally, if a potential winner is from Canada, he/she will be required to correctly answer and return, within ten (10) days from the date the Declaration is sent, a mathematical skill testing question to be answered without any assistance of any kind, whether mechanical or otherwise, in order to be eligible to receive a prize. In the event that the potential winner fails to correctly answer and/or return the skills test (if applicable), or if a potential winner is disqualified for any other reason, Sponsor will award the applicable prize to an alternate potential winner in a random drawing from among all remaining eligible entries.

If for any reason a prize cannot be awarded as contemplated by these Official Rules, then Sponsor will conduct a “Last Chance” drawing on or about thirty (30) days after the close of the Entry Period. Any prize that could not be awarded will be included in the Last Chance drawing, and the potential winner of that prize will be selected at random from among all remaining eligible entries. If after three attempts to award a prize a winner cannot be confirmed, that prize will not be awarded. In the event that an entrant under the age of majority in his/her state, province or territory of residence is selected as eligible to win a prize, the prize will be awarded to that entrant’s parent or legal guardian. Limit: one (1) prize per person or Twitter handle. The odds of winning a prize depend upon the number of eligible entries which are received.

For all prizes: The total value of prizes will equal approximately US $4998. Prize value accurate as of November 24, 2010. Prices and exchange rates may vary, and dealers may sell for less. Prize must be accepted as awarded and may not be transferred, substituted or redeemed for cash or otherwise, except at Sponsor’s sole discretion or as contemplated herein. Sponsor reserves the right to substitute a prize of equal or greater monetary value if the prize, or any component of the prize, cannot be awarded for any reason. Sponsor is responsible only for prize delivery; not responsible for prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of prize winners. All prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion.

8. Release: By receipt of the prize, the winner agrees to release and hold harmless Sponsor, GLOBALFOUNDRIES, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.

9. Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s use of winner’s name, image, likeness, personal testimonial and city and country of residence for promotional purposes in any media or format, worldwide, without further payment or consideration, including but not limited to posting winner lists online.

10. General Conditions: Sponsor reserves the right to terminate, amend, suspend or modify this Sweepstakes in whole or in part, at any time and without notice or obligation, if in Sponsor’s sole discretion, any factor interferes with its proper conduct as contemplated by these Official Rules. Without limiting the generality of the foregoing, if, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or of any other provision of these Official Rules.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

11. Limitations of Liability: The Released Parties are not responsible, to the extent permitted by law, for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or omission or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California or the appropriate California State Court located in Santa Clara County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. Some jurisdictions do not allow for limitations of certain remedies or damages and so this provision may not apply to you.

13. Sweepstakes Results; Posting of Official Rules: A list of winners will be posted on http://blogs.amd.com/play for at least four weeks following the close of the Sweepstakes.
