MSI DKA790GX Platinum Mobo Has No Chipset Heatsink Clearance

Why would a motherboard company design a chipset cooler that actually hits the reference AMD processor heatsink?
It doesn't impact the way the heatsink sits on the processor from what I could tell from the thermal compound imprint, but why design it that tight to where things touch?
Here is a different angle of the chipset cooler on the 790GX chipset and the processor cpu cooler on the MSI DKA790GX Platinum motherboard.
